QUESTION Assaalamu alykum warahmatullahi wa barakatuhu Mufti Saab I have an enquiry about a certain type of zikr. My shaikh who is a shaikh in the Naqshbandi Silsila prescribed for me muraqabah, which is to sit in solitude with one's head down and to think that nobody is in the world except me and Allah Subhanahoo, then to imagine a beam of noor is coming from the Arsh of Allah into the heart, and all evil and filth of the dunya is being extinguished from the heart and the heart is replying by saying ALLAH ALLAH ALLAH, not with the tongue, but just with the heart. Then after doing this exercise regularly the spiritual heart begins to vibrate then it begins to say ALLAH ALLAH itself all day and all night, then it flows with the name of ALLAH. This is the zikr of the Naqshbandi Silsila Besides the heart, there are 6 other points in the body known as lataaif, the same exercise is then done on all of these. Can you shed some light upon this please? Is doing zikr on the heart jaaiz? Is it not bid'at? If I start this will I be doing bid'at? And are the 7 lataaif also rewardable? May Allah reward you with the best in the dunya and akhirat. ANSWER The Muraaqbah is correct. There are six Lataa-if in the human body, and according to some Auliya there are eight. While the muraaqabah is correct, it is improper to prescribe it for a beginner. If the Naqshabandi shaikh to whom you are connected is Zulfiqar Ahmad, then know that he is not a reliable Shaikh of Tasawwuf. He is not a staunch upholder of the Sunnah. In fact, he flagrantly perpetrates fisq and fujoor. It is therefore not permissible to be related to such a person. You are liable to stray from the Shariah. A qualified Shaikh of Tasawwuf will first prescribe Taubah and emphasize observance of the Shariah and adoption of the Sunnah. It is improper and not permissible to involve a beginner in practices which have no relationship with the Sunnah and the Shariah. Many people have gone astray and were ruined in bid'ah and self-conceit with these types of acts prescribed by miscreant so-called 'shaikhs'. These occult acts are not acts of ibaadat. They are not deeds for which there is thawaab (reward). They are spiritual remedies to treat ailments. But quacks regard these practices as the highest form of ibaadat. This is bid'ah and dangerous. They prescribe such practices for all and sundry. Our advice is that you should not engage in this type of Muraaqabah. Rather engage in the Muraaqabah which Rasulullah (sallallahu alayhi wasallam) himself had prescribed for the entire Ummah, and that is Muraaqabah Maut and Muhaasabah. At night spend a few minutes in solitude and reflect on Maut and the Qabr. Muhaasabah is to reflect on the day's events – your deeds and statements during the day. Reflect on this and recite Istighfaar. Do not at this stage become involved in practices bordering on the occult. It could be spiritually detrimental. Furthermore, our advice is that you should politely and respectfully sever your relationship with the person who is supposed to be a Naqshabandi shaikh, but who has not as yet smelt of the frangrance of Naqshabandiyyat, leave alone having set foot in the spiritual Path of the Naqshabandi Sufi Tariqah. He is astray and engages in such practices and acts which detract not only from the Office of Masheekhat, but from the Shariah itself. Should you accept this advice, then after having terminated your bay't, do not be disrespectful. Do not speak ill of the person. While we criticize the man in order to save Muslims from falling into the trap of dhalaal (deviation), the mureed who terminates his relationship should not speak ill of his former shaikh even if he is a bid'ati. May Allah Ta'ala guide you and protect our Imaan. Besides a word of kufr, the most dangerous word with heart-rending consequences is Talaaq. From the innumerable letters we receive on this issue, we understand that Talaaq is being grossly misused on a massive scale. The effect is irreversible, and the regret is enduring. When provoked by the wife's indiscretion, the husband flaring up with anger reacts with the utterance of Talaaq, and many a time, with THREE Talaaqs to his eternal regret – a regret which is futile for the damage is irreparable. Just recently a husband and wife whilst engaging in affectionate play, laughingly uttered three Talaaqs. The wife too uttered three divorces. Although her utterance is baseless and the divorce is not valid, the husband jokingly said divorce to her three times. Immediately thereafter, understanding the implications of his utterance, he hastened to the Ulama for the fatwa. But it was too late. Several Ulama confirmed the validity of the three Talaaqs. Now it is worse than a funeral in his house. His stupid carelessness has shattered his home and his life. Both are crying profusely, but the damage is irreparable. Talaaq uttered in anger, love or joke is valid. Another moron woman in an argument with her husband shoved a paper and pen into his face demanding that he writes out Talaaq. The moron husband, incensed by the indiscretion of the stupid woman of deficient intelligence reacted like a woman, and in anger wrote out three Talaaqs and gave it to her. As soon as he had administered the three Talaaq, she was shocked, and wailed to no avail. Now she wants to know why he had written the Talaaqs. The brains of people operate in weird ways. When husband and wife argue and fall into shaitaan's trap, even the supposedly intelligent man behaves in bizarre ways. He utterly debases his intelligence and whatever dignity he may have. They conduct themselves worse than animals. Regardless of anger and how severe it may be, never utter the word Talaaq. This word should be eliminated from the husband's vocabularly. Every man who has uttered Talaaq emotionally has regretted. Some trade their Imaan by becoming Salafis to 'benefit' from the baatil Salafi view that three Talaaqs are to be considered as one Talaaq, in the way Christians believe with their doctrine of trinity – that three gods equal one god. Many others who lack fear for Allah Ta'ala, and who are Muslim by default, simply live together as husband and wife. They lead a life of adultery producing illegitimate children. At the time of their death, they are still living an adulterous life. Remember that Talaaq, no matter how it is administered, whether in anger or love, whether three in one session or spread over years, is valid. Three Talaaqs uttered at once are THREE divorces, not one as the juhala propagate. Even if the wife is in the state of haidh or pregnancy, Talaaq will be valid despite it being sinful to issue Talaaq in these states. Nevertheless, the Talaaq is valid. Furthermore, even if the word Talaaq or any of its derivatives or its translation in any language, is uttered without intention, then too the Talaaq is valid. Q. When does a small sin become big? A. There is no such thing as a small sin. All sins are big and liable for punishment. The issue of a sin being 'small' is of mere technical import. One sin is 'small' in relation to another sin. An abusive word uttered is 'small' in relation to physically assaulting a person. It comes in the Hadith: "Beware of regarding sins to be small." Q. How long does a person remain a faasiq? A. A person remains a faasiq as long as he commits fisq, i.e. flagrant sin. When he repents and abandons his flagrant sinning, then he ceases being a faasiq. If he believes that his fisq is not fisq and that it is permissible, then he becomes a kaafir (rejector). Q. Does a faasiq loose all rights which are for Muslims? A. Fisq cancels certain rights of the Muslim, not all rights. For example, while he is involved in fisq, he should not be greeted nor honoured. But all other rights applicable to Muslims remain. Q. Please comment on Gulen and the American Turkish Society. All books we receive in this prison (in U.S.A.) are from this society. A. Gulen is not a Muslim. He is in cahoots with U.S. conspirators. The American Turkish Society is a Gulenist movement. It should not be trusted. They are all part of a conspiracy against Islam. Q. While in Ihraam I washed my hands on two different days with scented soap. Do I have to pay a penalty? A. If the soap was scented/ perfumed, then you are liable for the dumm penalty. If on the two different occasions scented soap was used to wash the hands, then two dumm are compulsory. Two goats/sheep have to be sacrificed in the Haram area. If the soap was not scented, then there is no penalty. Q. I had forgotten to perform the two raka'ts after completing Tawaaf. I remembered the next day, and performed it. Do I have to pay a penalty? A. While this unnecessary delay is Makrooh (and sinful), there is no penalty. However, repentance is necessary. Q. I know that the reward of reciting the Qur'aan Shareef could be for a deceased person. Can it also be for a person who is alive? A. Yes, the Qur'aan Majeed may be recited for even a person who is alive. Make dua asking Allah Ta'ala to bestow the thawaab of the recital to whomever you wish. Q. A person leads a comfortable life. He has a house, vehicle, etc. However, he does not have the Nisaab of Zakaat. Can I give him my Zakaat? A. It is not permissible to give the person Zakaat. He has ample food to eat, clothes to wear and a nice house and car. Zakaat is the Haqq primarily of the Fuqara and Masaakeen. Q. What is the ruling regarding kuffaar eating styles (eating with knife and fork, and from tables, etc.), and kuffaar dress styles for a Muslim who has been born in western culture? For the rest of his life these styles were norms for him. A. It is Waajib to abandon western eating styles as well as western dress even if these were the norms since birth. Once one is made aware, it will no longer be permissible to emulate the kuffaar by adhering to their ways of life. Q. A Muslim became a murtad. Does it still remain obligatory to pay the debt owing to him? A. Yes, the debt owed to the murtad has to be paid. The Muslim heirs of the murtad will inherit his/ her estate. It should be paid to his heirs. Q. The Hanafi Muslims in the prison in the State of Tennesse, who follow the Mujlisul Ulama of S.A., separate themselves from the rest of the Muslim community in this prison. They do not join us in Ta'leem nor in Ramadhaan. Is this the teaching of the Musjlisul Ulama? A. Why do the Hanafi Muslims separate themselves from the rest of the group of Muslims in the prison? Before we can comment, it is necessary that we be apprized of their reasons for their action. Please ask some of them to write to us explaining the motive for their stance. We shall then comment and advise, Insha-Allah. Q. At this prison, with the approval of the chaplain, the prison gates are opened to allow outside Muslims to also participate in Jumuah Salaat. Imaams from outside come into the prison to lead the Jumuah Salaat. Will Jumuah be valid in the prison? A. As far as Jumuah Salaat in prison is concerned, it is difficult for us to accept that the prison literally opens its gates to allow outside Muslims to attend. We accept that the prison allows outside imaams to come into the prison to conduct the Khutbah and Salaat, but it is difficult to accept that the gates are literally thrown open to allow just any and all Muslims of the outside public to attend. We need independent confirmation for this claim. Assuming that what you are saying is true, and that Muslims from the street can simply walk into the prison to attend Jumuah, then according to the Hanafi Math-hab, the Jumuah will be valid. But, according to the other three Math-habs it will still not be valid. The issue of general permission is a condition only in terms of the Hanafi Math-hab. Q. I had an appointment with the dentist for extracting my tooth during Ramadhaan. That day I made intention to fast. However, before going to the dentist, I broke the fast because I knew that the fast will break while my tooth is being extracted. I am not sure if I am now liable for the 60 day Kaffaarah. Please advise A. You have to keep only one Qadha. In this case there is no Kaffaarah. Q. If a husband and wife have contracted a Khula' separation, does he have to maintain her during the Iddat? A. Khula' does not waive her right o f n a f q a h a n d m a s k a n (maintenance) during the Iddat. However, if she explicitly waives her right of nafqah, then only will the man be absolved. Q. Please comment on this R100 Qur'aan class. Is this permissible? Rasulullah (sallallahu alayhi wasallam) said: "Recite the Qur'aan. Do not eat by means of it. ….The majority of the munaafiqeen of my Ummah are its qaaris.' In another narration pertaining to the Signs of Qiyaamah, it is mentioned: "The dunya will be pursued with the amal (deeds) of the Aakhirah." Another Hadith states: "Knowledge (of the Deen) will be acquired for purposes other than the Deen." All of these Ahaadith as well as many others are applicable to the miserable 'shaikh' who trades the Qur'aan for a miserable price. He nourishes his body with the haraam money he derives from selling the Qur'aan Majeed so miserably and cheaply. This faasiq so-called 'sheikh' aggravates his villainy by inviting even women to participate in his haraam classes which he presents as Qur'aanic classes. It is not permissible to participate in programmes of this nature. Q. My brother is in dire straits financially. Can I give him my Zakaat? A. It is permissible for a person to give his Zakaat to his brother who is in debt/difficulty. Q. In our kutub is mentioned the permissibility of women participating in Jihad. Please explain this. This is being used to justify ladies tabligh jamaat. A. The emergence of women in Jihad mentioned in our kitaab pertains to a situation where Jihad has become Fardh Ain. Only in such a case will it be necessary for them to participate in Jihad. When Jihad devolves as an Fardh-e-Ain obligation, then the wife does not require the permission of her husband nor the daughter the permission of her father to emerge from the home to take part in Jihad. There is absolutely no basis in this for the makshufaat (women who cast off the home Hijaab to enter into the public domain) of the Tabligh Jamaat. The first and highest degree of Hijaab is to remain within the home precincts, and not to emerge from this holy environment without such need which the Shariah expressly gives. Justifying makshufaat jamaat on the basis of Fardh-e-Ain Jihad is preposterous and moronic. Q. Jewellery of R20,000 is given as mehr. However, the gold value in the jewellery is R10,000. What will be the value considered for the mehr be? A. In the example you have given, the value is of no significance. The actual jewellery item is the Mehr. Regardless of its value or gold content, since it has been accepted as the Mehr by the parties, the value is of no consideration. The actual item is the Mehr. Q. Is it permissible to give wedding rings to males? A. It is not permissible to give wedding rings to males. This custom has no relationship with Islam. Q. Can we sell doormats on which are inscribed words such as 'Welcome', etc. A. It is not permissible to tramp on the mats on which writing has been inscribed, hence not permissible to sell such mats. Q. A mufti issued a fatwa from the mimbar stating that on the Day of Qiyaamah, Allah Ta'ala will ask you why you never made tableegh to your non-Muslim workers in your shop and your maid at home? Please advise. A. The mufti should be asked if Hadhrat Jibraeel (alayhis salaam) had brought Wahi to inform him that Allah Ta'ala will pose the question on the Day of Qiyaamah. His statement is the effect of ghulu' which is in turn the effect of takabbur. While explaining the Deen to non-Muslims is meritorious, to claim what the maajin fellow said is a slander uttered in the Name of Allah Ta'ala. His statement comes within the purview of the aayat: "Verily shaitaan instructs you with evil and immorality and that you fabricate about Allah what you know not." Q. I read in your book, Tabligh Jamaat –Beware of Ghulu', that it was wrong to have a special Ulama section at the Ijtimas and have special bayaans for only the Ulama to the exclusion of the masses. Everybody believes this to be right. It now sets me thinking: Why is it that the Ulama are separated from the general public and special facilities are arranged for them? At the Ijtimas the Ulama have their own special sleeping quarters, plenty of food, the best cakes, drinks, and you name it, they have it. It never occurred to me that this is all wrong. If the Ulama practise mujaahadah (struggle against the nafs) it will have a better effect on the masses. A. Yes, indeed it will. But Rasulullah's predictions have to materialize. The Hadith criticizes obese ulama. Obesity due to gluttonous indulgence in sumptuous dishes and worldly luxuries enslaves a man to his nafs. It is for this reason that the world today abound with ulama-e-soo' and maajin muftis. They justify all their khuraafaat in the name of the Deen. Some decades ago when Hadhrat Masihullah (rahmatullah alayh) was in South Africa, the senior Ulama in Durban requested him to give a bayaan specially for the Ulama. Hadhrat Masihullah refused. He said that he would give a bayaan for all and sundry. The Ulama may attend the bayaan where he will address them in general. In other words, whatever naseehat there is for others applies also to the Ulama. There is no such thing as 'khusoosi' bayaans for the Ulama. These special bayaans and special treatment which the Tablighis arrange for the Ulama at their Ijtimas are effects of takabbur and riya. Preventing the general public from attending the so-called ulama bayaans is vile in the extreme. It is to prevent others from the Thikr of Allah Ta'ala. There is no basis for debarring people from attending Deeni lectures. The Ta'leem of the Deen is for all and sundry. Q. Many Muslim girls nowadays travel without mahrams. They visit all sorts of places, even haraam places. This is made easier for them because they are unaccompanied by mahram males. Please comment on this evil situation. A. Hijaab has long ago died. The Ulama have killed it, and have brought the women into the streets. They are the first criminals which have extinguished Purdah thereby snatching away the haya of Muslim females. Q. FNB offers a 31 day interest free loan service. However, they have an initiation fee of 13%. Will it be permissible to take such a loan? A. In fact, the 'initiation' fee of 13% is riba. Shaitaan has simply advised them to resort to a gimmick. It is haraam to obtain this loan. Q. Is FNB's mudharabah deal compliant with the Shariah? A. The FNB 'mudharabah' product is in conflict with the Shariah. It is not permissible. Q. I agree with you about the views you have expressed regarding ISIS. However, a greater danger for the Ummah than ISIS is the Ulama. I am sending you just a brief list of the misdeeds of the Ulama. I am not speaking about sins committed in privacy. There are many more of their misdeeds – public evils – which I shall send you. I am speaking of our own Deobandi Ulama. A. We are in agreement with you that the molvis of this era (we do not refer to them as Ulama) are a greater danger than ISIS. The examples of their shenanigans you have mentioned are facts. In fact, we are aware of much worse. You will frequently observe in our writings criticism and naseehat for the ulama-e-soo'. Feel free to forward more facts on this issue. We shall, Insha-Allah, prepare another article on the subject of the danger to Imaan and Akhlaaq which the molvis who masquerade as Deobandis pose to the masses. Having studied at a Deobandi-affiliated Madrasah does not qualify one as an Aalim of Deoband. A person who recites the Kalimah, performs Salaat, fasts in Ramadhaan, pays Zakaat, performs Hajj and generally acts in accordance with the tenets of Islam, is not a Muslim if he rejects even one fundamental of the Deen, e.g. he denies the finality of Nubuwwat. Similarly, those who indulge flagrantly in acts or ascribe to such believes which are in conflict with the Maslak of the Akaabir Ulama of Deoband, are never Deobandis. Q. Islaahi ijtimas seem to have become a trend among the khanqah people. Formerly we have not heard of this type of function. Please comment A. These new-fangled 'islaahi ijtimas' are the latest addition to the list of bid'ah acts introduced by those who are supposedly Ulama of Deoband. The motive is publicity. These are gatherings of nafsaaniyat. Such ijtimas were unknown to the Akaabireen. Q. I have given up music and have repented. What can I do with my piano? Am I allowed to sell it to a non-Muslim? It is a very expensive item. A. The world with all its wealth is not equal to the value of even one Subhaanallaah Tasbeeh. In fact, it comes in the Hadith that everything between the heavens and the earth put together is not the equivalent of a Tasbeeh. The monetary value should not deter you from observing the Shariah. The determinant is the ruling of the Shariah. A piano is haraam. Music is haraam. The only option regarding the piano is to break it and dump it. It may not be sold to even non-Muslims. This is a test for one's Imaan. Q. Is it permissible to buy and sell 'talk-time'? A. "Talk Time" is a fact. It is an entity which is capable of being used, and it is being used. It can be controlled and used at one's discretion. Without this 'commodity', the phone is useless. Its operation is dependent on the availability of 'talk time'. It is permissible to buy and sell this commodity. Q. I cater for wedding, birthday and similar kinds of functions. Is my business halaal? A. I'aanat alal Ma'siyat (aiding sin and transgression) is haraam by the clear Aayaat of the Qur'aan Majeed. Catering for haraam functions is not permissible. Money acquired in this manner is contaminated. Q. The nephew of a woman's husband grew up in front of her. Now that he is an adult is it necessary to have purdah for him? A. The woman has to observe purdah for the nephew of her husband regardless of him having grown up in front of her. Q. At walimah feasts, a lady makes a loud congregational dua before the feast commences. Is this also part of the walimah? A. The dua by one of the ladies before the walimah meal is bid'ah. Q. Is it permissible to say for a deceased Muslim: "Rest in peace". A. It is not permissible. Q. Is it permissible to use re-claimed (recycled) water? A. Recycled water is najis. It is haraam filth. It may not be used to wash even floors. Q. What is the status of a Muslim who finds fault with the Islamic laws of inheritance? A. A person who denies/rejects, or finds fault with the Islamic laws of inheritance loses his Imaan. He becomes a murtad. Q. A man has usurped the inheritance of others. He invites us for meals. Is it permissible to respond to his invitation? A. It is not permissible to consume the food provided by a man who usurps the inheritance of the heirs. People should not accept his invitations or attend his functions. Q. Before consummation of the marriage, the husband gave his wife one Talaaq. Can he take her back without renewing Nikah? A. In view of the fact that the marriage was not consummated, the one Talaaq is Baa-in, that is, the Nikah bond is totally and finally terminated. The Nikah has to be renewed if they decided to reconcile. Q. The deceased is survived by his pregnant wife, mother, and father. How should his estate be distributed? A. The unborn child must be assumed to be a boy. Thus, the estate will be divided into 24 shares and the distribution will be as follows: Father 4, Mother 4, Wife, 3 and the balance of 13 shares will be for the unborn baby assumed to be a boy. The brothers do not inherit in this case. If the child is a girl, the distribution of the 24 shares will have to be re-arranged as follows: Father 5, Mother 4, Wife 3, and daughter 12. Q. A man after performing Hajj, gives himself the title of Al-Haaj. He also writes and signs his name with this title. Is this riya? A. Yes it is riya when a person desires to be called Al-Haaj. It is just like a person who performs regular Salaat wishing to be called Musalli. Hajj is an ibaadat. The objective of ibaadat is Allah's Pleasure, not to gain and hanker after titles. Q. What should one do if the Iqaamah commences while one is performing the Sunnat Salaat? A. If you are in the first or second raka't, then end the Salaat on the second raka't. If you are in the third or fourth raka't, then complete the Salaat. If the four raka't Sunnatul Muakkadah of Zuhr is terminated with two raka'ts, then after the Fardh, perform four raka'ts. These four raka'ts should be performed after the two raka'ts Sunnatul Muakkadah. Q. Whose property are the wild kudus and other wild animals on a farm belonging to someone? These animals roam from one location to the other. They have not been bought and let loose by the farmer on his farm. A. Wild animals do not belong to the owner of the farm/land. Whoever captures them, is their owner. Only wild animals bought by the farmer belong to him. Q. Muslim children are increasingly taking to drugs. What is the remedy? A. The primary cause for drug-addiction in the Muslim community is parents who have adopted the kuffaar lifestyle. All patterns of kuffaar lifestyle are adopted by Muslims. What then should be expected? The company with whom Muslim children mingle is condoned by Muslim parents. Muslim children, from early childhood, are given all the freedoms which kuffaar parents allow their children. The greater part of the child's growing life is squandered in evil company in secular schools, sports, television, cell phones, functions and the like. All the evil consequences of western life are therefore necessary corollaries and to be expected. As long as this is the condition of parents, drug-addiction, vice and immorality will be on the increase. There is no remedy in this scenario. Q. Is it permissible to leave the Musjid after the Imaam's Salaam? Is it permissible to engage in Sunnat Salaat while the Imaam is still busy with a long dua? A. It is permissible to leave the Musjid after the Imaam has terminated the Jamaat Salaat with Salaam. The Sunnats may be performed at home. However, one should not unnecessarily abandon the Dua after the Fardh Salaat. After Zuhr, Isha and Maghrib, make a short silent dua. There is no need to wait until the Imaam ends his long dua. After Fajr and Asr Fardh, the Dua is usually longer. It depends on the individual. Again it is not necessary to remain as long as the Imaam makes dua. After the short dua one may leave to avoid becoming involved in conversation outside the Musjid. It is permissible, in fact necessary, to engage in the Sunnat Salaat whilst the Imaam is involved with his long bid'ah dua. Q. Is it necessary for Hijaab between a woman and her adopted son who is now an adult, and also between a man and his adopted daughter who is also an adult? A. The adopted children are not the sons and daughters of the persons who had adopted them. All rules of Hijaab are applicable. Q. What is kushu' in Salaat? A. Khushu is fear, humility and concentration in Salaat. This is a condition which is the effect of total obedience to the Shariah and adoption of the Sunnah. Its acquisition depends on Islaah (reformation) of the nafs. As long as the nafs is soiled with evil attributes, khushu' is not possible. Khushu' cannot be simply willed into a person nor will only dua for this condition benefit. It is a gift from Allah Ta'ala for the one whose gaze is focused on the Aakhirah, not on the dunya. Q. Is it permissible for a woman to put eyedrops into the eyes of a male who is working with her? A. It is haraam for a woman to apply eye drops to a ghair mahram male. It is also haraam to work with such a male. It is haraam for a woman to work in a place where she is exposed to males. Q. Is it permissible to begin the six days of fasting in Shawwaal the day after Eid? A. It is permissible to begin the six days of fasting the day after Eid, i.e. 2 Shawwaal. Q. Is it necessary to wash new garments before wearing? A. There is no Shar'i incumbency to wash new garments. Q. Are mushrooms cultivated in chicken faeces halaal? A. Whilst mushrooms cultivated in chicken faeces are better than those cultivated in swine faeces, and whilst such mushrooms are not haraam, it is best to abstain from that which is cultivated in filth. It has a detrimental spiritual effect. Q. Some imams have the habit of ending the qiraa't just before the Aayat of Sajdah. This they do to avoid making Sajdah. Is this practice proper? A. It is Makrooh (sinful and forbidden) to terminate the qiraa't in Salaat just before the Aayat of Sajdah in order to avoid making the Sajdah. This practice is despicable and not permissible. Q. Does Ruku' substitute for Sajdah Sahw? A. Ruku' does not substitute for Sajdah Sahw although it does for Sajdah Tilaawat. The Salaat remains defective and has to be repeated within the valid time of that Salaat in which the irregularity is committed. Q. In Kwazulu-Natal some Qur'aan tilaawat groups have started. For example, a group of 10 recites a Juz a day on their own and in their own time. Once each Juz has been recited, they have to report back via whatsapp to the group, and in this way many khatams will be made. If due to laziness one does not recite one's Juz, one will feel too embarrassed for not reporting one's tilaawat for that day. So, this will motivate the person to make sure he recites. Please comment on this system of tilaawat. A. The Qur'aan Majeed is not up for mockery, play and sport. Competitions may not be run with the Qur'aan Majeed. Ibaadat is not for advertising. Private/Nafl Ibaadat should be concealed, not publicized. This tilaawat system is bid'ah. It is not permissible to advertise ibaadat nor to orchestrate it in this manner. Others should not be informed of one's acts of ibaadat. This system is not permissible. Q. Does an illegitimate girl inherit in the estate of her brother? A. The illegitimate girl will inherit from her brother, sister and mother. She will not inherit in the estate of her biological father. Q. A fasting person fainted and remained unconscious for a couple of hours. Is his fast valid? He was not given any medicine, to consume. A. As long as no medicine, water, etc. was administered to the patient, his fast remains valid. There is no Qadha since his fast is valid. Q. A senior Moulana of the NNB Jamiat (No Name Brand Jamiat of Fordsburg) who is employed by the NNB's radio, together with his wife came to Virgin Active gym on the 6th day of Shawwaal. The music was blaring in the gym. The couple toured the gym, then sat down with the gym's consultant. Then they signed the papers to become members. I am aware that the Moulana's conduct is reprehensible. How can a Moulana justify his public haraam activity? A. The ulama-e-soo' are adept in the art of justifying haraam – fisq, fujoor and even zina as this miserable scoundrel with his miserable faahishah wife have demonstrated. This type of evil 'scholar for dollars' is in the business to trade his Imaan for a miserable price. They rob ignorant Muslims of their Imaan. They themselves lose their Imaan with their justification of haraam shehanigans. Q. A Shaafi Aalim issued a faskh, annulling a marriage without calling the husband to the hearing. On the story of the woman alone, he annulled the Nikah. Is the faskh valid? A. The 'faskh' issued by the Shaafi in the manner described by you is null and void. The Nikah remains valid. The woman remains in her husband's Nikah. Q. A scholar says that according to Imaam Qurtubi, oral sex is permissible? I have read your article saying that it is haraam. A. Even if Imaam Qurtubi allowed the filthy evil practice of oral sex, it remains haraam. We don't follow the errors of the Ulama. The Qur'aan Majeed criticizing and reprimanding Bani Israaeel says: "They took their ahbaar (scholars) and ruhbaan (saints) for gods besides Allah….." While we honour and respect the Ulama, we do not worship them. We set aside their errors and we follow the Shariah. Oral sex is haraam. Q. Is the dua after the Fardh Salaat part of the Salaat? A. The dua after the Fardh Namaaz is not part of the Namaaz. The Namaaz ends with Salaam. Making Dua after Namaaz is Sunnat. Making a loud dua with the Jamaat is Bid'ah. Everyone should engage silently in making his own Dua. Q. Is Nouman Ali Khan a reliable person? A. We are not aware of this gentleman. We have never heard of Nouman Ali Khan. Q. Is it permissible to sell recipe books if a couple of the recipes have pork and liquor as ingredients. A. It is not permissible to sell a recipe book which has even one pork/liquor recipe. Q. Is it permissible to sell medical books which also have yoga treatments? A. The medical books with yoga remedies are not permissible to sell. Q. Some darul ulooms encourage their students to pursue higher secular studies. Please comment. A. Some 'darul ulooms' are darul jahals (abodes of ignorance), hence they encourage their students to pursue haraam. They are signs of Qiyaamah. They use the Deen to acquire the dunya. Rasulullah (sallallahu alayhi wasallam) said: "Recite the Qur'aan. Do not eat by means of the Qur'aan." That is: Do not use the Qur'aan – the Deen – for worldly motives and objectives. Q. Is it permissible to establish jamaat khaanahs in shopping malls? A. These haraam, immoral, filthy malls are not suitable for Jamaat khaanas. Nevertheless, if you are trapped in such an evil place and the time of Salaat is about to expire, then perform Salaat even in such a jamaat khaanah. Q. A group called Ruqahas set up business in South Africa. Their leader is a Tunisian. They treat jadoo (magic) and exorcise jinn, etc. Is this group reliable? They charge R450 for a session. A. The group is deviate. They are mercenaries. Their sole objective is money. They use the Deen to gain money. Stay away from them. Q. What should the Hanafi muqtadis do when the Shaafi' Imaam does not make Sajdah which is Waajib for Hanafis? Will our Salaat be valid if we do not make the Sajdah? A. When performing behind a Shaafi' Imaam, the Hanafi muqtadis should not make the Sajdah Tilaawat which applies to Hanafis. The Imaam has to be followed. The Salaat of the Hanfis is valid. Q. With total disregard for the wishes and needs of the majority of the musallis, the trustees of the Grey Street Musjid in Durban have installed high-pan western toilet. Most of the musallis are severely inconvenienced by these unhygienic, awkward kuffaar style toilets. We find urine on the pans. Please comment. A. The problem is that these trustees are fussaaq and fujjaar. They have little truck with the Shariah. They are not concerned with Islamic hygiene. Filth is therefore quite acceptable to them. They are increasingly inclining towards kufr. The toilet is in fact a reflection of the kufr in their hearts. If the musallis are part of the voting system of the Musjid's management, then the corrupt trustees should be voted out. It will then be possible to change the toilets. Q. If Mahr is not paid, will the Nikah be valid? A. Mahr is Waajiib. It is the right of the woman. It is Waajib to pay Mahr. However, Mahr is not a condition for the validity of the Nikah. While the Nikah is valid without Mahr, the Mahr remains Waajib. Q. A Muslim believes that mother Thereasa is a Jannati. What is the status of his Imaan? A. His belief is kufr. He has to renew his Imaan. Only the Mu'mineen will enter Jannat. Q. A man had two wives. From the first wife he had 1 son and 3 daughters. From the second wife he had 2 sons and 2 daughters. Some unmarried daughter from the first wife has passed away. She left behind jewellery. How should her assets be divided according to the Shariah? A Mufti said that the jewellery goes to only the first wife's children. Was he right? A. We have understood that when the daughter passed away, both her parents were not alive. Both had passed away before her. If this is so, then her heirs are only her one full brother and her two full sisters. Her half-brothers and sisters do not inherit. The jewellery and all her assets should be divided into four equal shares. The brother receives two shares, and each sister one share. The Mufti was right. Q. Muslim rappers are on the increase in the U.K. Rapping is a gangster street-style music. Muslim youths are increasingly becoming addicted to this evil. Please offer some advice. A. The Qur'aan Majeed says that advice benefits only the Mu'min. Indulgence in evils of this type constrains one to believe that the perpetrators of what you call 'rapping' are not Muslims. The blame for the ruin of the young lies squarely on the shoulders of parents. They are the primary cause for the moral and spiritual destruction of their children. Muslim youth today are trapped in evil of a variety of sorts. Those who are concerned and view with abhorrence and dismay the rapid slide of Muslims into the dregs of moral degeneration, can only proclaim the truth. There is nothing beyond this which could be done to save the community. Muslims have volitionally chosen the path of kufr, fisq and fujoor. The situation is set to become worse. It will not improve. The evil destroying the Ummah is not restricted to the youth. The entire Ummah – the young and the old – is sliding down the slippery path of evil into the abyss of Jahannam. We can only make dua and supplicate for safety. We can only shout and proclaim that these evils are haram and those indulging therein will be the fuel of Hell -Fire. Q. Is it permissible to use a plate on which a lobster is engraved? A. It is not permissible to use a plate or eat from a plate on which a lobster is engraved. Q. In which way can we assist the suffering refugees of Syria? A. The only way to assist the suffering refugees of Syria is to provide monetary aid. But our people are squandering millions of rands in mock, mass I'tikaafs' which have become festivals of eat and excrete. More millions of rands are squandered in haraam wedding functions, holidaying in the guise of Umrah, and in many other wasteful avenues. The hearts have become callous and cruel. May Allah Ta'ala guide this lost and disobedient Ummah. Q. Is it permissible to use bedding on which are pictures if butterflies? A. It is not permissible to use bedding with pictures of butterflies. Butterflies are animate objects. Even if the eyes are not shown, the pictures are clearly understood to be of butterflies. Q. Are zero hour contracts permissible? A. Zero hour contracts are not permissible. Q. Salafis say that Surah Faatihah is not part of the Qur'aan. What is the proof for it being part of the Qur'aan? A. Salafis are morons (juhala). Don't contaminate your Imaan listening to their jahl. First inform us of the proof for the Qur'aan Majeed -- that the Qur'aan which you are today reciting is the Qur'aan revealed to Rasulullah (sallallahu alayhi wasallam). On providing this proof, we shall discuss the issue of Surah Faatihah. Q. The house in which we are living belongs to my father. He bought it with a loan acquired from a bank. He is still paying the interest on this property. Is this house halaal? Will the heirs inherit it? A. The house is not haraam. The interest paid is haraam and a grave sin. All the heirs of your father will inherit in the house. The same applies to all assets purchased on interest. While the interest which is paid is haraam, the assets are halaal. However, if the asset is purchased with interest or any other haraam money, then it will be haraam. Q. Due to negligence a lady has accumulated about 200 Qadha fasts. Now her health does not allow her to fast. Should she pay Kaffaarah? A. If the lady is genuinely unable to fast to fulfil the fasts which she had missed, then she should pay Kaffaarah. The Kaffaarah for each fast is approximately R20 (twenty rands) or about 2 kg flour. However, should she at any time regain her heath, then she will still have to fast regardless of having paid the Kaffaarah. Q. My cell phone fell into the toilet pan. I managed to clean it. Can I still use it to display Allah's Name and the Qur'aan Shareef? A. Although it is permissible to use the phone, Allah's Name and Qur'aan Majeed should not be displayed on the phone which was retrieved from the toilet pan. This instrument is no longer fit for Allah's Name. It should be sold to a non-Muslim, and another phone be procured. Q. I have violated about 25 oaths. How should I expiate this sin? A. The expiation (Kaffaarah) for an oath is the price of about 2 kilograms flour. It is valid to pay the Kaffaarah in cash. But the Kaffaarah of one oath must be given to only one poor Muslim. It may not be divided and given to two persons. Also, on one day, the Kaffaarah of two oaths may not be given to one person. On one day, several Kaffarah amounts may be given to several persons. If a person is genuinely unable to afford the monetary Kaffaarah, then for one oath he has to fast three consecutive days, i.e. one after the after without an in between break. It is permissible to pay the Kaffaarah over a period of time as one is able to afford. It is not incumbent to pay the Kaffaarah of all the 25 oaths in a lump sum immediately. Q. A girl eloped with a man and married without the consent of her father. The couple had been conducting an illicit relationship for many months. Is the Nikah valid? A. A marriage without the blessings and duas of parents usually ends in the rocks. The type of haraam marriage arrangement you have described almost always ends in misery. Any relationship based on zina will necessarily be beset with misery and end in misery. We have seen too many of these episodes being enacted in this era. Marriage without the consent of the Wali and the Duas of parents is the very last resort. There must be a valid Shar'i reason for taking such a drastic step. Nikah without the consent of the Wali is baatil (null and void) according to the three Math-habs. Whilst the Nikah is valid according to the Hanafi Math-hab, it is a major sin. Marriage without the consent of the Wali is not permissible notwithstanding the validity of the Nikah according to the Hanafi Math-hab. In our time the fundamental cause of such marriages are parents themselves. They have not only abandoned Hijaab, they in fact scorn Hijaab. They send their daughters to schools and they provide instruments of zina such as cell phones and haraam internet facilities for their children. The logical consequences of such an evil upbringing is zina and the elimination of haya. Girls running away with boys is now almost a norm. Parents should live 'comfortably' with the consequences of their own evil. One only reaps what one has sown. Q. A relative went to his wealthy uncle seeking assistance to pay his electricity bill. His electricity was cut off. The uncle refusing, said: "Go stay in a squatter camp!" This uncle has an estate of R50 million. What advice is there for him? A. The Qur'aan Majeed issues the following warning and naseehat to this evil bakheel (miser): "Those who are miserly with that (wealth) which Allah has bestowed to them by His Grace, should not think that it (their bukhl/miserliness) is best for them. On the contrary, it is evil for them. Soon shall that (wealth) with which they are miserly be strung around their necks (in the form of hot steel chains) on the Day of Qiyaamah." In another Aayat, the Qur'aan Majeed warns: "They who hoard gold and silver, and do not spend it in the Path of Allah, give them the tidings of a painful chastisement. On that Day (of Qiyaamah) it will be heated in the Fire of Jahannam, then their foreheads, their sides and their backs will be branded with it. (It will be said to them): 'This is what you had hoarded for yourselves. Now taste that which you used to hoard." The heart of this uncle is further aptly depicted in the Qur'aanic aayat: "Then their hearts became hard like stone or harder than even stone, for verily from stone gush forth rivers. And some of it (rocks) split open and springs come forth. And, some of it (stones) roll down (from heights) because of fear for Allah." Yet the heart of the miser remains unmoved by the plight of even a close relative in distress. This is the meaning of a heart harder than rock. May Allah Ta'ala save us from such calamities. Q. Is commercially made ice cream halaal? According to SANHA the ice cream of more than two dozen companies is halaal. Please comment. A. SANHA's certifying is laughable. SANHA halaalizes 100% carrion. Carrion chickens and kuffaar meat products are all halaalized by SANHA the Carrion Certifier. The objective is only to gain haraam boodle. These shayaateen in human form have sold their Imaan for the carrion of the dunya. Rasulullah (sallallahu alayhi wasallam) said: "The dunyah is jeefah (carrion)." That is precisely what all these miserable carrion halaalizers are pursuing. So what is the conundrum if this agent of Iblees certifies haraam ice cream to be halaal? The doubt in a product NOT certified by SANHA is less than the doubt of a product certified by the Chief Carrion halaalizer. For example, if a certain brand of ice cream is not certified by SANHA, than it is quite possible that this brand will be halaal while the brands certified by SANHA will be haraam. All ice cream made commercially is HARAAM. Besides haraam gelatine, these ice creams contain stabilizers, emulsifiers, colourants, essences and perhaps other haraam muck disguised with some chemical swear word or number. If you are concerned with your Imaan, then abstain from all brands of commercial ice cream. A very concerned sister from England writes: Assalamu alaykum, I am living in Birmingham, UK. I find myself in a dilemma and very concerned with what the future holds. Despite this being a city with a very big Muslim population, I feel there is no barakah, no sense of tranquility and serenity. Rather I sense that something terrible is on the way. The reason is: I see sisters do something with sincere intentions but with haraam means because they genuinely trust the 'scholars' (scholars for dollars – boot-lickers and bootleggers –The Majlis) whom they believe are real scholars. Things are very confusing because in this city, and in the UK, there are no scholars talking out against the ulama-e-soo and the Haraam rulings being given by 'scholars' to sincere sisters and brothers who are mostly ignorant and will follow naively. These ulama-e-soo' are doing their own 'ijtihad' by saying that times have changed so the ruling should be changed too. Many sisters follow and are direct students of these ulama-e-soo', because there do not seem to be any alternative scholars to go to, and no other scholars are highlighting errors and warning the people. So sincere people who are new to Islam or newly practicing on the deen will naturally trust these ulama-s-soo'. To give an example, a sister wanted to raise money for her Alimi institute that's forever eating the money of it's students and other people. The naive sister who is still really ignorant even though she is in the 4th year of alimah course (Jaahilah course – The Majlis) in that institute, recently took part in a marathon which entails wearing tight clothes, free mixing, running out in the open, etc. I have advised this sister previously myself but it fell on the deaf ears. Why should the sister listen to a layperson like myself when she has so many 'great' and 'knowledgeable' scholars(Juhala predicted by Rasulullah –sallallahu alayhi wasallam – The Majlis) to take rulings from? I know people have informed the Alimi institute a while ago about the bad behaviour of many of their female-students who are now in the higher years of the Alimi course and about to become the next generation of 'Alimahs' (Jaahilahs will lead other jaahilahs. Signs of Qiyaamah - The Majlis) from whom people will take rulings. Not only this institute but many other institutes seem to be producing the same type of 'Alimahs' with really bad adab and akhlaaq, and following the wrong rulings of their scholars. There is no emphasis at all on Tasawwuf and Taqwa. And maybe they're not completely to blame for not putting emphasis on Tasawwuf because the people of Tasawwuf in Birmingham do weird stuff, like constantly over-praising their shaykh, saying 'shaykh did this', or 'shaykh had this for breakfast', or 'shaykh dreamt something today' and so on, and becoming more and more similar to the tasawwuf cults of the Barelwis. So these new 'Alimahs' along with their teachers think that such Tasawwuf is more of a problem and no longer necessary. One example of a wrong ruling that the Ulama of these institutes give to their students is that for 'special' circumstances a group of sisters can travel more than 48 miles as long as there is one mahram of one of the sisters in the group. Some of my close relatives and friends follow this ruling and it looks like any Aalim can decide when these 'special' circumstances apply. But I was even more shocked to learn that this ruling is not a new ruling. The senior Ulama of the big madrasahs in this country issued this ruling many years ago, when girls madrasahs started. In order that girls can be transported from their homes to these madrasahs, the senior ulama said that one mahram in the van or coach is sufficient. They also said that this is a very 'special' ruling and should not be publicised. I request The Majlis to comment on this ruling of senior ulama of the UK who are very big and famous 'buzurgs', and regarded as 'Walis' of Allah. (Genuine Ulama and Walis do not issue haraam twaddle as 'fatwas'. – The Masjlis) Who can decide when to apply these 'special circumstances'? Now it looks like any group of Aalims and buzurgs can decide when these 'special' circumstances apply so that women can travel over 48 miles in a group. And then other Aalimahs take further advantage of this ruling by deciding that they can decide themselves when these 'special' circumstances apply such as going sight-seeing to 'appreciate' the wonders of Allah, and even coming home extremely late at night. This state of affairs exists even though the situation in this country is getting worse and worse in terms of safety. Just recently a sister wearing a hijab who was waiting at a bus stop was dragged to a nearby bush, violently assaulted and dishournoured terribly. I see sisters who are sincerely practicing and new to Islam but are extremely naive and confused. How do I convince them not to follow the 'ulama-e-soo' and instead stick to the original fiqh rulings like those in Beheshti Zewar? When I give such advice, these sisters don't listen, and I ask myself why should these sisters even listen to me? What qualification do I have compared to the big mufti titles of their teachers who quote even bigger muftis and buzurgs to justify their rulings. I wanted to ask, as these things are becoming more apparent in our community, I am worried that Allah's athaab is on its way due to these sins and lack of taqwa in the community. What is a layperson to do? Should I email the relevant ulamas and explain what they and their Alimahs are doing is affecting the community? Should I warn people of these ulama as there is no other ulama reprimanding them and tell them not to attend their classes? My heart is in despair. I am crying because people have started to use the religion to fulfil their desires and what they want to believe to be the deen. Basically deen is being used for dunya with even sincere but ignorant people being dragged in. It hurts me that they are upsetting Allah. Allah has put it in my heart to email you regarding this, and seek advice on what can I do. Sometimes its difficult, and I wish to do hijrah to South Africa because it seems there might still be true scholars there. Here in Birmingham things are just going worse and worse, and it is affecting so many families who I know personally, and I am afraid of Allah's athaab coming. As sisters who are struggling with holding onto deen, who can not find good company in this day and age. What advice do you have for them? Jazak'Allah khayr for reading this. (End of the Sister's lament). Sister, South Africa is not much better than the rotten state of U.K. where you are living. This is the era of the increase of the ulama-e-soo'. Just as in the U.K., there is a glut of these worldly 'scholars' – scholars for dollars' – evil molvis and sheikhs in South Africa. There is really no place to migrate to. Remain where you are and do for the Deen and for yourself whatever you are able to, and leave the end result to Allah Ta'ala. As long as you are concerned and do what Allah Ta'ala wants you to do, you will be saved from His Athaab, Insha-Allah, when Q. An insurance company called 'Ammanah' which is advertising 'Dawaah' street signs is advertising 'halaal' insurance policies. Is it true that its insurance is halaal? A. Don't be deceived by the haraam advertising and the chimera of so-called 'da'wah' street signs and the Qur'aanic verses which this miscreant company uses to advertise its haraam riba insurance. These fellows don't even know how to spell da'wah and amaanah. The moron ulama-e-soo' who have halaalized the riba insurance of these companies and camouflaging the haraam muck with an Islamically sounding designation such as 'takafol' which in reality has no relationship with the Shariah, are bootleggers whose objective is monetary gain. The street signs are a dastardly gimmick utilizing the Deen to pursue despicable worldly objectives. Hadhrat Abdullah Ibn Mas'ood (radhiyallahu anhu) narrating a Hadith pertaining to the Signs of Qiyaamah, said: "The dunya will be searched with the amal (deed) of the Aakhirah." This is precisely what this insurance company and its halaalizers are guilty of. We are not aware if the owners of this company are Muslim or kuffaar. Nevertheless, it is a stark materialization of the aforementioned prediction of Rasulullah (sallallahu alayhi wasallam) to use the Qur'aan as an advertising stunt. Presenting its advertising stunt to sell its haraam insurance, the Ammanah (sic) insurance company says: "From Surah Bakarah and Hadeeth of Prophet SAW we know that riba is a major sin for us, and one we must totally abstain from in order to avoid the wrath of our Creator. We have thus ensured that whatever products are provided by Ammanah IFS are free of Riba and are Shariah approved." Yes, approved by the ulama-e-soo' (evil scholars for dollars). All these so-called 'shariah-compliant' products are HARAAM. All forms of insurance are HARAAM. Do not be deceived by the name, 'takafol'. It is simply a shaitaani gimmick to hoodwink the ignorant masses into the Satanism of RIBA. Furthermore, whilst this company pretends to be a muballigh it corrupts the Durood for our Nabi (sallallahu alayhi wasallam) with the stupid abbreviation, 'SAW". What is 'SAW"? It is to see in the past, or it is a metal tool to cut timber. It is never a Durood. Islam does not teach us to sing: 'saw, saw, saw' after mentioning th Holy name of Nabi-e-kareem (sallallahu alayhi wasallam). It is not permissible to use abbreviations for the Durood. Don't say even 'prophet'. Say: Rasulullah (sallallahu alayhi wasallam). it settles on the community. You may write to the 'scholars' and ulama-e-soo' to discharge the obligation of Amr Bil Ma'roof Nahyi Anil Munkar. Tampering with the Shariah and legalizing what Allah Ta'ala has made haraam is tantamount to kufr. Those 'scholars' who have claimed that it is permissible for a group of women to travel with a ghair mahram male as long as he is accompanied by a mahramah (female), are zindeeqs. They are following in the footsteps of the ulama-e-soo' of Bani Israaeel whose profession it had become to tamper with and alter the Tauraah and the Shariah of Nabi Musa (alayhis salaam). These ulama-e-soo' are embarking on the same mission initiated by the ulama-e-soo' of Bani Israaeel. They are astray and they mislead others. They are juhalah who deceive and misguide the juhalah among the masses. The so-called 'special circumstances' hallucinated by these scoundrel 'scholars' is a typical example of Talbeesul Iblees (Deception of the Devil). With this absolutely ludicrous argument the ulama-e-soo' deem it appropriate to tamper and mutilate the crystal clear command of the Shariah regarding the prohibition of females travelling without their male mahrams. Anyhow, we have to reconcile ourselves with the predictions of Rasulullah (sallallahu alayhi wasallam). Fulfilment of predictions is a sign of the truth of Nubuwwat. Rasulullah (sallallahu alayhi wasallam) had predicted the present degenerate state of the 'scholars', hence he said: "Verily, I fear for my Ummah the Aimmah Mudhilleen." They are the 'scholars for dollars' – the 'scholars of deviation – the 'scholars' who are astray and lead others astray as well. They prowl the world today in search of nafsaani gratification and securing worldly goals in the name of the Deen. Stating this fact, Hadhrat Abdullah Ibn Mas'ood (radhiyallahu anhu) mentioning some of the signs of Qiyaamah, said: "The dunya will be pursued with the amal of the Aakhirah." Deeds which are exclusively for the Hereafter, will be presented as a front to entrap people for the sake of monetary purposes and other base nafsaani motives. Regarding these ulama-e-soo' Rasulullah (sallallahu alayhi wasallam) said: "There will dawn a time when nothing will remain of Islam but its name. Nothing will remain of the Qur'aan but its text. The Musaajid will be beautifully adorned structures, but devoid of guidance. The worst of the people under the canopy of the sky will be their ulama. From them will emanate fitnah and the fitnah will rebound on them." Rasulullah's predictions are materializing right in front of our eyes. These ulama-e-soo' to whom you have referred are running amok with the Deen all over the world, not only in the U.K. They are vermin eating away the foundations of Islam. But Allah Ta'ala has His Own plans to thwart these vile shayaateen in human form. There will always be the group of Haqq to proclaim the pristine pure Deen and the Sunnah of Rasulullah (sallallahu alayhi wasallam). These villains masquerading as Ulama and Shaikhs of Tasawwuf should hang their heads in shame and disgrace for tampering and mutilating the Ahkaam of the Shariah. Israaf (waste / extravagance) is an attribute of Iblees. On the basis of this evil satanic attribute, the Qur'aan Majeed describes the wasters as Ikhwaanush Shayaateen (the brothers of the devils). The gravity and notoriety of Israaf can therefore not be over-emphasized even if one makes such an endeavour. Israaf is always evil and destructive, spiritually as well as physically. It is the effect of takabbur (pride) and riya (show). Only those who have opted for deliberate spiritual blindness will have the capacity to deny the huge shaitaani Israaf which occurs at all mass I'tikaaf functions and festivals. While I'tikaaf is supposed to be an Ibaadat in which the emphasis is on Zuhd (Abstinence/renunciation of the dunya),Muraaqabah and Muhaasabah, The mock mass 'i'tikaaf' of these days is the very antithesis of the Masnoon I'tikaaf observed by Rasulullah (sallallahu alayi wasallam) and the Sahaabah. These bid'ah i'tikaaf festivals resemble haraam wedding receptions. The attributes which are supposed to be cultivated in I'tikaaf are utterly eliminated by shaitaani indulgence in israaf, fisq and fujoor – all of which have been discussed in this treatise. The fujoor aspect is specially associated with the presence of women and the haraam tawajjuh stunts of the modernist quack 'sufi' who has not yet set foot in the Path of genuine Tasawwuf. Millions of rands of the bounty of wealth are being squandered down the sewerage drains in the orgiastic 'I'tikaaf' programmes of the 'hadhrats' who are paving the paths of Jahannam for their unsuspecting flocks revelling in the festivities organized during the most auspicious days and nights of Ramadhaan. Allah Ta'ala did not bestow wealth to people for wasting on festivities, unnecessary journeys, setting up huge expensive tents and the other wasteful expenditure concomitant with the paraphernalia of the mock mass I'tikaaf festivals. All over the world, millions of Muslims are languishing in squalor, poverty and appalling jahaalat – total ignorance of the very basic requisites of the Deen so imperative for sustaining Imaan. The suffering of Muslim men, women and children of Syria, Gaza and Burma are currently in the public glare. Yet these quack and crank 'hadhrats' feigning total physical blindness, mislead their followers, casting them into the cauldron of shaitaani Israaf. They are spiritually blind as the Qur'aan Majeed aptly depicts them: "Verily, the (physical) eyes are not blind, but the eyes within the breasts (hearts) are blind." It is this spiritual blindness which has calcified their understanding preventing them from progressive thinking, hence they believe that their misdeeds are deeds of virtue, as the Qur'aan Majeed states: "Say: 'Shall I inform you about the losers?' They are those whose effort is wasted in this worldly life whilst they think that what they are doing is goodness." These wasters and indulgers in mock mass 'i'tikaaf' believe that their deeds of waste and sin are acts of virtue. They are in fact the losers in this dunya and in the Aakhirat. In every remote village of the world where there are droves of ignorant Muslims, the kuffaar missionaries are active in their poselytizing depradations. Millions of ignorant Muslims, especially children in rural villages are the targets of the missionaries, modernism and kufr. Maktabs to educate these children in the elementary teachings of Islam, to enable them to know what Imaan is, to recite the Qur'an, to perform Salaat, etc. are non-existent. The millions which are wasted on these festivals in the name of 'i'tikaaf, should rather be diverted to establishing Maktabs, feeding the orphans, the widows and the suffering masses of Muslims uprooted from their homes. They live in horrible and heart-rending conditions. Whole families live huddled together under plastic sheeting, not even a decent hut. They scavenge like animals for food, whilst the 'hadhrats' and their flocks indulge in luxuries and festivities eat gluttonously and excrete. Does their Imaan demand such callous and insensitive conduct? Do they not know that the demand of Imaan has been explained by Rasulullah (sallallahu alayhi wasallam): "The Muslimoon (the Ummah of Islam) is like one person. If the eye pains, The whole body is affected. If the head pains, the whole body is affected." What has happened to the brotherly pain which should be in the heart of every Believer – throbbing in his heart at the misery of the suffering Ummah? How can Muslims in Ramadhaan indulge in satanic extravagance when the Ummah is being ground and crushed by suffering and misery. The Ummah is engulfed by the forces of kufr, yet those who indulge in 'i'tikaaf' festivities, happily lose themselves in satanic waste like villains revelling in orgies of drunkenness. The colossal Israaf of these haraam, bid'ah functions which pollutes the Holy Month of Ramadhaan and defiles the sanctity of the Musaajid can feed thousands of suffering widows, orphans and others gripped by hunger and poverty. But, this reality simply does not dawn on the fossilized brains of the revellers. How is it possible for Imaan to tolerate this huge shaitaani Israaf amid the misery and suffering of the Ummah? Perhaps the treasure of Imaan has been extinguished. Q. Many Ahaadith mention huge rewards for virtuous deeds. For example a Hadith states that if a menstruating woman recites Tasbeeh or Istighfaar at the time of every Salaat, she will receive the reward of a thousand raka'ts Salaat, etc. Are such narrations authentic? Some Ulama say that generally such Ahaadith are fabricated. Please comment. A. It is not correct to brand such narrations as fabricated. The Ulama who do so appear to be influenced by Salafi attitudes. Salafis summarily label any Hadith which is unpalatable to them as fabricated. A Hadith is not fabricated simply because it is not to be found in the Sihaah Sittah. Besides the Six Authentic kitaabs of Hadith, there are numerous other highly authentic kutub of Ahaadith. Most Ulama are unaware of these Kutub, hence they baselessly criticize and wrongly label many Ahaadith in the way Salafis do. Imaam Bukhaari (rahmatullah alayh) alone had memorized over 700,000 Ahaadith while his Saheeh contains only a fraction of these narration. 90% of the Ahaadith are not recorded in the Sihaah Sittah. The Aimmah of Hadith did not claim that Saheeh Ahaadith are restricted to their compilations. On the contrary, they explicitly mentioned that their kitaabs do not encompass all the Saheeh Ahaadith. It will therefore be in the Imaani interests of molvis who emulate the deviate Salafis to exercise caution and not to recklessly brand Ahaadith as fabrications simply because they are unable to locate the sources. It is indeed dangerous to say that a Hadith is fabricated merely because it is not included in the kutub which are well-known. What is the basis for claiming that the virtues mentioned in the narration pertaining to the Tasbeeh of a menstruating woman are fabricated? If the Hadith is narrated by senior Ulama and it appears in their kutub, it may not be dismissed as a fabrication simply because it is not to be found in the Sihaah Sittah. When the Hadith does not conflict with any teaching of the Shariah, and on the contrary, it confirms a practice ordered by the Shariah, then what is the imperative need to brand it a fabrication? The stance for adoption is the instruction of Rasulullah (sallallahu alayhi wasallam) regarding the narrations of Bani Israa-eel. Rasulullah (sallallahu alayhi wasallam) said: "Neither confirm authenticity nor belie it." Since there is the real possibility of the narration being authentic, silence is the best and the safest option. When we are ordered to adopt silence for even the riwaayaat of Bani Israaeel, then to a greater degree will this instruction be applicable when the narration happens to be a Hadith attributed to Rasulullah (sallallahu alayhi wasallam), and when there is no conflict with the Shariah. Westernization with its consequence of Kufrization (production of kufr in the minds of Muslims) have desensitized the Imaan of Muslims to the degree of kufr. The Call of Allah Azza Wa Jal via His Shariah no longer makes an impact on the brains and hearts of even the so-called ulama who will prepare elaborate 'fatwas' of jahaalat to present destructive poisons 'halaal' for Muslim consumption. Thus we see Muftis while ignoring the mass of fisq, fujoor, bid'ah and kufr in which the Ummah is sinking, leaving no stone unturned in their shaitaani attempt to make 'halaal' poisonous filth such as soft drinks. For achieving this nefarious objective, these muftis hallucinate 'daleels' to force the hillat of the intoxicant ethanol for the sole reason of making 'halaal' the poisonous fizzy drinks which are destroying the health of the nation. The thinking of the ulama have become so kufr-oriented that their primary concerns on life have become halaalization of haraam. Thus, halaaization of poisons, filth, carrion and riba are among their vile feats they accomplish in their darul iftas. The physical health, the spiritual health, the moral health, Allah's Pleasure and the Concerns of Maut, Barzakh and the Aakhirah are today no longer the objectives of the Darul Ulooms, Darul Iftas and Khaanqas. Everything and all the focus is on the acquisition of the dunya and gratification of the inordinate bestial demands of the nafs. Fizzy soft drinks, fruit drinks, energy drinks and sweetened iced teas are causing thousands of deaths and have no health benefits, they said. And they warned that governments across the world should make it a priority to eliminate such drinks from people's diets. Researchers said sugary drinks were to blame for 133 000 diabetes deaths worldwide in one year. Another 45 000 died from cardiovascular disease and 6 450 from cancer. They said 1 316 people died as a result of drinking sweetened drinks in the UK – the 28th worst rate of death in a list of 51. Top was Mexico, where 30 percent of adult deaths under 45 were attributed to sugary drinks, while Japan was lowest with one percent. Kawther Hashem, a nutritionist from the campaign group Action on Sugar, said: "More evidence is showing the alarming impact of sugary drinks on our health, the healthcare service and the economy. It is time these huge profit-making drinks companies took to reformulating their products with less sugar." The study looked at sodas, fruit drinks, sports or energy drinks, sweetened iced teas and homemade sugary drinks that contained at least 50 calories per 240ml. A can of Coca-Cola contains 101 calories per 240ml or 139 overall. Dariush Mozaffarian, from Tufts University, Boston, and a senior author of the study, said the focus should be on cutting the drinks out of diets in order to save lives. "It should be a global priority to substantially reduce or eliminate sugarsweetened beverages from the diet," he said. "Some population dietary changes, such as increasing fruits and vegetables, can be challenging due to agriculture, costs, storage, and other complexities. This is not complicated. "There are no health benefits from sugarsweetened beverages, and the potential impact of reducing consumption is saving tens of thousands of deaths each year." Researchers, whose findings were published in the journal Circulation, examined 611 971 deaths from 1989 to 2010. Younger adults were more dramatically affected than older people. Gitanjali Singh, who also helped write the study, said: "If these young people continue to consume high levels as they age, the effects of high consumption will be compounded by the effects of ageing, leading to even higher death and disability rates from heart disease and diabetes than we are seeing now." Mexico had 405 deaths from sugary drinks per million adults in 2010 – about three times greater than the US, which had an estimated 125 deaths per million. About 76 percent of the overall deaths were in low or middle-income countries. What has happened to the Imaan of this child's parents? The Qur'aan says that only the men of intelligence ponder and derive lesson. Even minus the erratic load-shedding currently besetting the country, the chickens killed at the commercial killing plants and halaalized by SANHA, MJC, NIHT and other agents of Iblees, are HARAAM CARRION. Load-shedding has added a horrible aggravating dimension to the chicken-killing industry. When the power is cut, chickens passing upside down through the cruel electrocuting water-trough become stuck with their heads submerged in the water. Thousands of chickens remain hanging upside down on the stationery conveyer belts. Others perish horribly in the hot water tanks where they are scalded prior to defeathering. Just imagine the scenario with thousands of chickens hanging upside down, messing and defecating in the cruel position they are hanging. Those chickens which were not killed as a consequence of electrocution, regain consciousness. Imagine their pitiful plight hanging upside down and defecating. They remain in this cruel position for the duration of the power-cut. South African chicken producers will ask the government to help them guarantee electricity supply to the nation's biggest abattoirs as almost-daily power cuts are harming the birds' welfare and creating health risks. The slaughterhouses, some of which can process as many as 13 000 chickens hourly, can't rely on generators as they aren't able to create sufficient power for their needs, South African Poultry Association chief executive officer Kevin Lovell said. The birds are typically stunned unconscious by electrocution before they are decapitated while hanging upside down, he said. When power cuts interrupt the process, the birds "have been stunned but they haven't been killed; they're hanging upside down and they're coming back alive", he said at Bloomberg's offices in Johannesburg on June 26. "It's a real problem. And it's a huge waste problem because everything that stops in the process, sometimes hundreds of tonnes, has to be cleared. You have to clean and sterilise everything and then you have to dump at a medical waste site." Eskom Holdings, the state-owned company that supplies about 95% of power used in the continent's most industrialised economy, has cut supply almost every other day this year as it struggles to meet demand amid regular breakdowns of plants and delays starting up new units. While load-shedding follow schedules, it is sometimes imposed at a few minutes' notice. Eskom request There were blackouts on 20 days in June, according to data compiled by Bloomberg using alerts from Eskom. Abattoirs belonging to producers including RCL Foods and Astral Foods slaughtered about 958- million chickens last year, Lovell said. SAPA, as the poultry lobby is known, will approach the Department of Agriculture, Forestry and Fisheries about asking Eskom and municipalities to directly control power supply to 20 of the largest slaughterhouses, which process about80% of the country's production, and provide about eight hours' notice before cuts are introduced, Lovell said. Eskom will attempt to accommodate the needs of the poultry industry once producers have made an approach, Khulu Phasiwe, a spokesperson for Eskom, said by phone on Tuesday. A company operating in the Western Cape has arranged that it gets forewarned about planned disruptions and switches off supply to its feed mill during the day in exchange for not having electricity to its abbatoir cut, Lovell said. "Maybe that's the sort of solution we can come up with," he said. Sufficient warning Sufficient warning will limit losses and help processors and farmers plan transportation of the birds more efficiently, he said. "Farms need to be no more than two hours away from abattoirs as that's the sort of time period that the chickens can safely be contained in those crates" on trucks, he said. "If it starts to take longer than that, you start to get mortalities." Allah Ta'ala has made lawful for a man to marry a second, third and a fourth wife. Those who disapprove or dislike this Institution of Allah Ta'ala should renew their Imaan and their Nikah. The status of all the wives is the same. The first wife enjoys no preference with regards to treatment. Financial expenses, home and night times have to be equally distributed to the wives. Many men take second wives secretly, and the women condone the secret nature of their marriages only to regret later when the discovery is made. It should be remembered, that a marriage cannot remain a secret for too long. Furthermore, zina is a secret affair, not Nikah. Nikah is a public affair. It is unnatural and extremely harmful and heart-breaking in the long term to marry clandestinely and to dwell in the self-deceptive idea of the marriage remaining a perpetual secret. While a woman is naaqisul aql (deficient in intelligence), the man is not expected to inherit her attribute of nuqs fil aql. It is imperative that the man acts intelligently, not with his nafs. The emotional decision constrained by lustful passion will always be regretted later when the glamour of nafsaaniyat dissipates. The pious Sages of the Ummah said: "Verily, Allah loves a discerning gaze (i.e. wisdom/ insight) at the time of doubt, and (Allah loves) a perfect intelligence at the time when lust grips (a man)," It is extremely necessary to employ the intelligence correctly when there is the danger of involvement with the opposite sex. Imaam Ghazaali (rahmatullah alayh) said that when a man is entangled in an emotional trap with a woman, then 60% of his brain cells become inoperative, hence Allah Ta'ala loves a 'perfect intelligence' at such a juncture. The woman contemplating to become a second wife should not agree to be treated like a mistress. She should not agree to spend her days with her husband as if she is a prostitute engaged in a clandestine illicit affair playing hide and seek with the public as if she is on the run. Remember that if a man is unable to have a public second Nikah, he will soon buckle under the emotional pressure of his first wife and in-laws. When the first wife discovers the second wife, she will explode or implode and bring the roof crashing on her husband. We are aware of many cases where the first wife demands that her husband divorces his second wife otherwise she will pack up and leave with the children. Almost all men in secret marriages, submit. The second wife then finds herself deserted. It is not only the right of the second wife, but her obligation to insist that her Nikah and presence be made public. If the man is not prepared for this, stay far from him. Offer him a harsh goodbye. Do not cast yourself into such misery which you will regret and shed many tears of grief which will be of no avail. It is dishonourable to live as if you are a mistress or a prostitute when Allah Ta'ala has placed you – the second wife – on par with the first wife. It is infinitely better to remain single and lead an honourable life in solitude than be treated like a mistress in an illicit affair. I intend to purchase a property from the University Islamic Financial Corp. here in the U.S.A. where I am living. The transaction as explained by this Islamic institution will be a Murabahah one. I am sending the forms to you for checking and for advice. Is this Murabahah transaction in compliance with the Shariah? A. We have checked the muraabahah contract and have found several irregularities from the Islamic perspective. If the bank is just a bit more considerate it can very easily rectify the contract and the sale will be permissible. A Muraabahah sale according to the Shariah is a simple transaction consisting of the cost price plus the mutually agreed profit. In the example presented by the bank, the cost price of the property to the bank is $200,000 The bank's profit added is $266,992 The purchase price to be paid by the buyer $466,992 The purchase price is payable in 360 fixed monthly instalments as detailed in the Monthly Allocation Schedule. If the deal is structured in this simple form, it will be permissible. It will be a valid Muraabahah transaction. However, the following are some of the salient haraam factors: (a) Clause 2 of the Contract states: "The Murabaha Vendor acknowledges that it has previously received from the Purchaser a down payment of $50,000 towards the purchase price of the Property. Such amount shall not be deemed to be part of the Original Purchase Price owed under this Agreement and secured by the Mortgage." This stipulation is stupid, deceptive and haraam. It is stupid because in the same breath its avers that the $50,000 is part of the Purchase price and also NOT part of the Purchase price. Then in order to deceive the simple buyer, the purchase price is divided into two sections: an Original Purchase Price, and another purchase price for which no specific designation has been coined. According to the Shariah there can be only one fixed Purchase Price, and that price in the example is $466,992.It appears that the $50,000 is over and above the $466,992. Thus it is Riba – haraam interest. To overcome this, the bank should simply add it to the $466,992 to make the Purchase Price $516,992 (b) Clause 4 of the Contract reads: "If the Murabaha Vendor has not received the full amount of any monthly payment by the end of 15 calendar days after the date it is due, the Purchaser shall pay a $50 administrative charge to the Murabah Vendor's servicing agent………" This $50 charge is haraam Riba. To cover any such eventualities, the Murabaha Vendor may simply increase the Purchase Price by a couple of hundred dollars and work it into the monthly instalments. (c) Clause No.6 states: "The Purchaser may make a full Prepayment or partial Prepayments………. However, the Murabaha Vendor may apply the Purchaser's Prepayment to the accrued and unpaid Profit on the Prepayment amount, before applying the Purchaser's Prepayment to reduce the O r i g i n a l P u r c h a s e Price……" This condition is baatil and haraam. We have understood that a Prepayment in the context means a payment made in advance. The Murabaha Vendor is under Shar'i compulsion to deduct the Prepayment from the Purchase Price, that is from the $466,992, in this example. It may not utilize any amount from it for any other cost or charge. (d) The following occurs in Clause 7: "…..the Purchaser agrees that it shall either pay or reimburse the Murabaha Vendor for all costs, charges and expenses incurred in connection with the sale by the original seller to the Murabaha Vendor,……….." This is totally unacceptable and haraam. The transaction between the Murabaha Vendor and the original seller has absolutely no relevancy to the Purchaser of the property, i.e. the one who buys the property from the Murabaha Vendor. (e) In Clause No.12 the following appears: "If the Purchaser is in default………..the Murabaha Vendor may require the Purchaser to pay immediately the full amount of the Original Purchase Price which has not been paid and all Profit that the Purchaser owes on that amount." This stipulation is in conflict with the Shariah, hence not permissible. The Murabaha Vendor has the right to only demand payment of the arrears, not of the full outstanding amount. While there are other stipulations in conflict with the Shariah, the aforementioned are some of the salient haraam features of the contract. If the bank rectifies these, then the sale will be permissible otherwise not. QUESTION A brother has an argument to justify Maulana Tariq Jameel's visits to fusaaq amd fujjaar, please comment. The brother says: "Moulana Tariq Jameel have visited places more worse that IK's House, i.e cinemas, mujras and have met people from all classes, even prostitutes.... just for the sake of Da'wat. Aren't these people the ummatis of Nabi sallallahu alaihe wasallam?" Those who criticize moulana's visit to Actors, actresses and politicians, give lectures just to deendar/ religious sect. Who will give da'awa to these ignorant, secular and non religious people? Moulana's da'wat has changed the lives of many people." How should the Tableegh to fusaaq and fujjaar be given? ANSWER Hidaayat (Guidance) is Allah's prerogative. No one has the power to bestow hidaayat to anyone. The Qur'aan Majeed declaring this principle, says to Rasulullah (sallallahu alayhi wasallam): "Verily, you (O Muhammad!) cannot give hidaayat to those whom you love. But Allah guides whomever He wills, and He knows best who are the ones to be guided." The obligation of the Ambiya and of the Muballigheen is only to deliver the Message of the Deen. Employment of haraam ways for Tabligh purposes is haraam. In the process of his ill-found methods of 'tableegh', Tariq Jameel indulges in haraam – in fisq and fujoor. His 'tabligh' is therefore baseless and haraam. Hidaayat does not pivot on his methods or the methods of anyone else. Allah Azza Wa Jal is PURE. He does not countenance filth and haraam. He is not in need of Haraam methodology which misguided individuals fabricate. Innumerable fussaaq and fujjaar all over the world had gained guidance from the original method of the Tabligh Jamaat. Almost all of these fussaaq and fujjaar do attend the Musjid even though it may not be on a regular basis. Almost all Tabligh Jamaat recruits were former fussaaq and fujjaar. Yet the Tabligh Jamaat did not go into brothels and cinemas and into Shiah temples to win over these people. They were enlisted in the Musjid. Allah Ta'ala did not allow Rasulullah (sallallahu alayhi wasallam) to deliver the Message of Islam by compromising with shirk, kufr, fisq and fujoor. The arguments which the miscreant 'muballigheen' proffer in justification of their haraam are all whisperings of shaitaan. The Muballigheen should restrict their methods to only what is halaal. Allah Ta'ala will guide whomever He wants. If Allah Ta'ala wants a faajir to become a muttaqi, He will create the circumstances and in an unexpected way link up the faajir with the people of the Deen who will become the medium for his reformation.
